Newscape Capital Group chief executive officer Stephen Decani has been charged with driving his Aston Martin whilst being almost double the legal drink-drive limit.
Decani was pulled over by plain clothes police officers soon after getting into his DB11 coupé on King’s Road in Chelsea on June 9 at 4.30am, reports the Evening Standard.
The asset management firm’s CEO denies drink-driving, claiming he 'regurgitated' in the moments leading up to his breathalyser test, which may have affected the reading. Police said he had a reading of 61 micrograms of alcohol in 100 millilitres of breath, with 35 being the legal limit.
Philip Lucas, Decani’s solicitor, told the court his client ‘disputes he consumed enough alcohol to put him above the legal limit.’
Lucas added: ‘The second issue is the reliability of the breath test. The defence has an expert witness. The defendant indicated he regurgitated at a particular point in the process and we have an expert report dealing with the effects of regurgitation on the results of the test.’
The trial adjourned until a date later by magistrate Nick Tarry because the police officer who carried out Decani’s breathalyser test was not present at the court to give evidence.
